Just over 10 years after the Alice v. CLS Bank decision, defenses under 35 U.S.C. 101 remain popular. But the best approaches for asserting and responding to Section 101 defenses remain under dispute, and the courts have provided little guidance. This panel will explore those strategies and the impact they can have on a case, including at trial.
